JOINT STATEMENT: UN declares the arrest and detention of journalist Mohamed Abuuja in Somalia is in violation of international law

MOGADISHU, Somalia, 16 September 2021 – Somali Journalists Syndicate (SJS), Somali Media Association (SOMA), and Robert F. Kennedy Human Rights welcome the opinion of the United Nations Working Group on Arbitrary Detention (UNWGAD) declaring the arrest and detention of our client, journalist Mohamed Abdiwahab Nuur (“Abuuja”), in Somalia arbitrary and in violation of international law. 

Mr. Nuur, a Somali human rights defender, journalist, and editor for Radio Hiigsi, has published pieces critical of the government since 2016. Throughout his work, he has bravely reported on abuses of power committed by the security forces, restrictions on freedom of expression, and the targeting of marginalized communities in the capital city of Mogadishu.

Somali authorities first detained him on February 29, 2020, in retaliation for an editorial he published three days earlier criticizing Somali security forces for engaging in threats and intimidation against Somali citizens. During that detention, officers tortured him and threatened to kill him if he continued his reporting. He was released a few days later on the condition that he would not speak about his detention; however, Mr. Nuur was vocal about his unlawful imprisonment and on March 7, 2020, National Intelligence and Security Agency (NISA) authorities re-arrested him. He was held incommunicado for 92 days before his lawyer was finally allowed to see him, and only officially charged on August 3, 2020 by a military court which ordered him to be released after nearly five months in detention. The UNWGAD issued an opinion despite his release as they are empowered to do through their mandate, due to the “extremely serious” nature of the case. 

“We are extremely glad to hear the decision by the UN Working Group on the case of our colleague Mohamed Abdiwahab Nuur (“Abuuja”)” said Abdalle Ahmed Mumin, the secretary general of Somali Journalists Syndicate (SJS). “This victorious decision paves a way for our colleague to get justice and we call on Somalia’s federal authorities to commission a full and independent investigation of the circumstances leading to the detention of Mr. Nuur and hold accountable those responsible,” he added. 

“The Somali Media Association (SOMA) welcomes this historic decision by the United Nations Working Group on Arbitrary Detention regarding the human rights abuses perpetrated against  journalist Mohamed Abdiwahab Nuur (“Abuuja”),” said Mohamed Osman Makaran, SOMA Secretary General. “It is now the responsibility of the Somalia Federal Government to ensure that journalist Nuur gets the justice he deserves.” 

The UN Working Group found that the government arbitrarily deprived Mr. Nuur of his liberty without a legal basis as a result of exercising his freedom of expression and violated his right to a fair trial. It also found that the Somali government violated his rights to non-discrimination, noting that “Mr. Nuur’s criticism of the Government and his persecution may be understood against the backdrop of the pervasive discrimination and persecution faced by the Somali Bantu ethnic minorities” of which Mr. Nuur is a member.

In its opinion, the UN Working Group calls on the Somali government to grant Mr. Nuur an enforceable right to compensation and other reparations, and urges the Government to undertake a full and independent investigation of the circumstances leading to his arrest and to hold accountable those responsible. The Working Group also referred the case to the UN Special Rapporteur on torture and other cruel, inhuman or degrading treatment or punishment, for further consideration.

“Abuuja’s case is emblematic of the restricted civic space and worrying trend of human rights abuses committed against journalists and human rights defenders by state authorities in Somalia,” said Angelita Baeyans, vice president of international advocacy and litigation at Robert F. Kennedy Human Rights. “We call upon the Somali government to implement the reparations for Mr. Nuur to remedy these violations and to take a positive step towards human rights protection and accountability.”

SJS, SOMA, and Robert F. Kennedy Human Rights appreciate the solidarity and support from International Media Support (IMS), attorney Michael Polak and human rights organizations, including Amnesty International and the Committee to Protect Journalists (CPJ) during Mr. Nuur’s detention.

SJS, SOMA sign a historic MOU to defend press freedom and improve media professionalism in Somalia

MOGADISHU, Somalia, 13 September 2021 – Somali Journalists Syndicate (SJS) and the Somali Media Association (SOMA) today signed a historic Memorandum of Understanding (MOU), which paves the way for enhancing media freedom, improving media professionalism and protecting journalists’ rights at the work places, safety and well-being of Somali journalists.

In an event held in Mogadishu, SJS Secretary General and SOMA Secretary General signed the 18-article document with the presence of SJS and SOMA officials, media managers and journalists.

SJS and SOMA also announced that other media and journalists’ networks are free to join in this endeavour in order to ensure free and stable press in Somalia.

“Today, on behalf of Somali Journalists Syndicate and the entire Somali media fraternity, I am glad to sign this important Memorandum of Understanding (MOU) with our colleagues from the employers’ association —the Somali Media Association. This gives our two organisations the strength to collaborate and defend media freedom and work hand-in-hand in advocating for journalists’ rights. it will also pave the way for ensuring gender equality, professionalizing media and improving the quality of the media content,” Abdalle Ahmed Mumin, SJS Secretary General said.

“Carrying out media development, press freedom and freedom of expression requires complex and extensive collaboration which involves national, regional and international actors. That is why SJS and SOMA have been working jointly since last year and we have achieved many successes in defending journalists’ and media rights. Through this new partnership, we hope to achieve even more,’ added Mr. Mumin.

“It is a historic day for the quest of free and independent press in Somalia. SOMA reiterates its commitment towards media freedom. Somali journalists and media houses have suffered a lot and they are facing even more threats than ever,” Mohamed Osman Makaran, SOMA Secretary General said. “Partnership with SJS will give protection to journalists, improve their safety and protect freedom of the press. Indeed, this partnership means to ensure increased impact for our joint efforts that our two organisations have been doing together.”

Below is the translated version of the Memorandum of Understanding signed by SJS and SOMA today:

1) Defending and advocating for media freedom, freedom of expression and the right to access to information.

2) Promoting an independent, sustainable and stable media in Somalia.

3) Improving the skills of media workers and enhancing their professional capacity.

4) Improving the quality of the local media content to reflect the needs and interests of the Somali people before, after and during the elections.

5) Ensuring media safety and security of journalists and staff in order to safely carry out their duties.

6) Improving working conditions of the journalists and improving their rights in terms of wages and other rights such as leave, health insurance and workplace security.

7) Strengthening media and journalists’ professionalism and their independence, and ensuring that media houses and their journalists are free from all interference and so that media institutions can fulfil their obligations towards achieving positive social change and better communities in Somalia.

8) Providing legal protection for journalists and media outlets whenever they are attacked as a result of their journalistic work.

9) Protecting the rights of women journalists in employment and equal pay and ensuring gender equality in the newsrooms.

10) Protecting the freedom of the press and preventing all forms of censorship.

11) Encouraging journalists working for SOMA member media houses to participate in SJS membership drive and advocating for trade union rights within the media houses.

12) Supporting the media outlets and journalists in distress, threatened or attacked, and participating in media freedom campaigns when needed.

13) Assisting media outlets in formulating and enforcing the Code of Conduct for Journalists and the Code of Safety.

14) Developing editors’ guide to protect freedom of expression and editorial content in accordance with international standards of freedom of expression.

15) Assist editors, managers and journalists across Somalia in building their professional capacity through training, workshops and other educational programs.

16) Creating a platform where knowledge, experience and other key information necessary for development can be shared between media managers and editors.

17) Assisting women journalists in taking up key management positions in the media outlets.

18) SJS and SOMA will collaborate and partner with other international organisations to defend the freedom of the media, journalists and their development and enhancement of the Somali media landscape.

SJS jointly trains 25 journalists from Galmudug and Puntland in Galkayo

MOGADISHU, Somalia 11 September 2021 – Somali Journalists Syndicate (SJS) has completed journalists’ safety and media freedom training for local journalists in Galkayo town, Mudug region on Thursday 9 September.

For the first time, this three-day training (7th – 9th September 2021) brought together 25 journalists from independent and state-media operating in Puntland and Galmudug. Supported by the Canada Fund for Local Initiatives (CFLI), the training aims to improve the safety of professional local journalists and strengthen media freedom in Somalia. Under this initiative, SJS intends to train around 80 journalists —half of them female — in four regions of the country.

“For years, Galkayo has been the second deadliest city for journalists in Somalia after Mogadishu. Almost all journalists killed in Galkayo were shot dead because of the type of stories they have worked on. We decided to train journalists in this city to improve their safety capacity, to strengthen their professional skills and to enhance their free expression,” Abdalle Ahmed Mumin, the Secretary General of Somali Journalists Syndicate (SJS) said.

In his opening remarks, Mr. Mumin called on Puntland and Galmudug authorities to stop their hostile treatment towards journalists, and allow independent media houses and journalists to operate in a safe environment without intimidation and censorship.

In collaboration with local media houses and journalists’ network, community leaders and government officials from Galmudug and Puntland regional states, SJS was able to invite journalists from both sides of Galmudug and Puntland, to enable them to work hand-in-hand and learn from each other.

“This is my first time to have such a training. I am grateful to SJS for the creativity and the commitment by bringing journalists from both sides of Galkayo together. As a journalist, I have never seen this. It made me feel excited,” said Muna Osman Isse, a female reporter who works at the oldest community-owned Radio Galkayo.

“Indeed, this training taught us new skills. I was arrested few months ago and my phones confiscated. I did not have any digital security knowledge. My social media platforms were breached. Thanks to SJS and CFLI, now I know how to protect my digital platforms,” said Mohamed Omar Yusuf, a journalist working for the privately-owned Radio Deegaan.

In addition to trainees, SJS invited local media directors, editors and reporters who have shared their experiences on a range of issues they have confronted to include death threats, arbitrary detention, torture as well as offline and online harassment and intimidation. Women journalists also shared their experiences of working in a hostile environment including physical threats, online harassment and intimidation.

At the conclusion of the three-day training, journalists agreed to establish a WhatsApp group and share safety related information and assist each other. The director of trainings of the Galmudug State’s Ministry of Information, Hassan Abdirahman also urged the trainees to put the knowledge and skills they gained into practice and share with other colleagues in their news stations.

“I would like to emphasise the importance of sharing skills, knowledge and information for the benefit of the journalists’ safety. Don’t hold the skills you have learnt to yourself. Utilise it and also try to share the skills with your colleagues so it can contribute to the safety and well-being of other journalists,” he added.

Director of Radio Galkayo, Mohamed Ali Siyad had congratulated SJS for selecting and training journalists from all media houses and freelancers in Galkayo.

“From what I have learnt from you and had seen since this morning, show how the training content was useful. I’m confident that it will improve the safety of the journalists in Galkayo. On behalf of the local media houses, I want to express my appreciation to SJS trainers and its leadership for providing this opportunity to our journalists,” said Director of Radio Galkayo, Mohamed Ali Siyad.

In his remarks, Galmudug’s Governor of Mudug, Abdirahman Diriye Is-hal praised the role of local journalists in promoting social cohesion, integration and building sustainable peace among Galkayo community. He said SJS training directly impacts this peace initiative.

“I’m extremely glad today to address these journalists from both sides of Puntland and Galmudug. Without doubt, this initiative will greatly enhance the safety of local journalists. I hope that journalists will continue to help our efforts towards peace, cohesion and integration in Galkayo since the public security of Galkayo impacts the security of the journalists,” the Governor added.

In his closing remarks, Galmudug Information Minister, Ahmed Shire Falagle who attended the closing session of the training, emphasised the role of the media in the community development and ensuring public accountability for good governance.

“Safety of journalists and press freedom is at utmost importance for us. We believe journalists have a great role in our society. I urge all journalists to strive for the truth and play a role in uniting the Somali people.  You have the power to influence and change the community,” Minister Falagle said “I know SJS has been focal on defending journalists. They have mentioned journalists who were arrested in Galmudug. We are sorry for those arrests and we’ve condemned it. My ministry will continue to advocate for the safety and protection of journalists.”

During the three-days of the training, SJS Secretary General, Abdalle Ahmed Mumin and his team who were in Galkayo attended the commemoration of the World Literacy Day at the Galkayo Public Library which promotes reading, peace and tolerance. Also, local journalists from both sides of the city hosted Secretary Mumin and colleagues to a joint dinner where individual journalists spoke about firsthand stories in becoming part of the Galkayo peace initiative.

MOGADISHU, Somalia, 05 September 2021 – Somali Journalists Syndicate (SJS) and the Somali Media Association (SOMA) strongly condemn the assault, beatings, use of live bullet and confiscation of equipment by Somali Police Force against journalists covering protesters in KM4 junction in Mogadishu today.

On Sunday afternoon, armed police officers from Hodan and Waberi districts attacked 12 journalists from the local and international news agencies, who were at KM4 junction to cover protesters demanding justice for missing National Intelligence and Security Agency (NISA) employee, Ikraan Tahlil Farah.  According to journalists, police used live bullets to disperse protesters and scare journalists, beat cameramen and confiscated their equipment.

Police also beat, dragged and briefly detained Goobjoog Media producer, Bashir Mohamud, while live-streaming the protest, resulting him to sustain bruises on various parts of his body. According to Director of Goobjoog Media, Hassan Mohamed Mohamud, Bashir was held at Hodan police station and was later released without charge. “Bashir is currently in the hospital and is receiving treatment for bruises he sustained,” Mohamud said.

SJS and SOMA strongly deplore the unwarranted act of use of violence by the police. We call for swift, public and transparent investigation into the officers responsible for today’s assault on the journalists. We call for Somalia’s international partners including United Nations, European Union, African Union and other governments who support Somali security forces to review its program, ensure accountability for police atrocities and urge to uphold human rights and press freedom.

“We strongly condemn this brutal act of beating, harassing, confiscation of journalists’ equipment and the arrest of Bashir Mohamud. Journalists were simply doing their duty and were targeted for that. In today’s assault, 12 journalists from various news media were affected,’ Abdalle Ahmed Mumin, the Secretary General of Somali Journalists Syndicate (SJS) said “We call on the Somali federal authorities to investigate this incident which clearly affects the country’s press freedom and ensure those responsible are brought to justice.”

“We are deeply saddened by the way the Somali police treated journalists covering KM4 demonstration in Mogadishu. We urge authorities to hold officers who committed these heinous violations accountable. No one is above the law,” Mohamed Osman Makaran, the Secretary General of Somali Media Association (SOMA).

On 22 August, the police detained three journalists covering another protest in Mogadishu.

MOGADISHU, Somalia, 01 September, 2021 – Somali Journalists Syndicate (SJS) on Wednesday opened the second part of a series of human rights journalism trainings in Beledweyne, Hiiraan region of Hirshabelle State.

The three-day training session, which follows another similar training in Mogadishu in late July, will equip and mentor 25 local journalists with new skills essential to collaboratively monitor, investigate, document and report human rights violations. It is the first ever human rights reporting training held in Hirshabelle State.

With funding from the National Endowment for Democracy (NED), SJS plans to train and mentor up to 150 journalists across Somalia over the next few months.

Officiating the training in Beledweyne, Hiiraan Deputy Governor, Sheikh Hussein Osman Ali described the training as a timely one amid an increase of human rights violations in the region, including increase of sexual violence against women and girls and the systematic marginalization affecting certain communities within society.

“I congratulate the SJS team for choosing our region and the local journalists to be trained in human rights reporting. This is a much-needed initiative. It helps my administration to denounce abuses against the most vulnerable groups and individuals in our society, ”said Sheikh Hussein.

“I would like to appeal to the local media to help us expose the perpetrators of these heinous human rights violations against our women and girls. It is shameful that a whole segment of the community is brutalized; women raped and families displaced and nobody is speaking for them”, adds Deputy Governor Sheikh Hussein “Another problem is the continued marginalization against certain communities in the employment, in the provision of healthcare and education. They are denied the services simply because they come from certain communities.”

On behalf of the regional and district administration, Sheikh Hussein later received copies of the training book and a booklet on the comparisons of articles that protect human rights in the Federal Constitution of Somalia and the constitutions of federal member states. to be discussed during the training. The two copies translated in Somali language were prepared by SJS.

On behalf of the local network of the Hiiraan Journalists Club, Radio Hiiraanweyn Deputy Director, Abdiweli Hussein Tawakal praised SJS efforts to ensure the inclusivity of the training participants from all sectors of the local media houses and freelancers.

SJS Secretary General, Abdalle Ahmed Mumin, who remotely joined the opening session, praised the Hiiraan Regional Administration authorities, Beledweyne District officials and local media networks for the warm and hospitable reception reserved for SJS trainers in the city.

“SJS leadership and member journalists are committed to be the voice of the voiceless communities. That is why we are in Hirshabelle State training these journalists today. Our aim is to capacitate local journalists, build their professional skills and enable them to professionally monitor, investigate, analyze and report information about human rights violations,” Mr. Mumin adds “Journalists are human rights defenders not only by reporting the violations but also by expressing concern about a human rights problem, engaging in dialogue and advocate with authorities, and propose recommendations for corrective actions. That is human rights journalism we want to see in Somalia.”

Somali Police briefly arrest 3 journos, obstruct and chase journalists covering a protest in Mogadishu

Mogadishu, Somalia 22 August, 2021 – Somali Journalists Syndicate (SJS) condemns the brief arrests, threats and obstruction of journalists from covering a protest in Mogadishu on Sunday morning 22 August, 2021 around 10:00am local time, the latest in a string of violence against the journalist and the media workers in Somalia.

Somali Police in Mogadishu’s Hodan district on Sunday morning briefly detained three journalists; Salad Mohamed Kheyre, Abdifatah Mohamed Roble both working for SOMNEWS TV as a reporter and Cameraman respectively and  Samiir Abdirisak Omar of Hanti-TV while covering a protest at KM4 area in Mogadishu against the African Union Union Mission of Somalia (AMISOM) for killing civilians in Lower Shabelle region.  Several other journalists also fled the scene after the police chased them.

The trio journalists who spoke with SJS  said that the police confiscated their equipment including cellphones, detained them in a Hodan Police station, where they were kept for an hour and half and were later released without charges. However, Hodan district police commissioner Bashiir Abdi Siyad told the journalists before they were released that “You were arrested for filming a protest, which is a crime, if you are caught a similar act again, you will be arrested for good”

Somali Journalists Syndicate (SJS) condemns today’s brief arrests, threats, intimidation and obstruction access to information by the police in the strongest terms possible and calls for the federal government of Somalia to end the police brutality against the journalists and the media stations in the country.

With Canadian funding, SJS trains 25 Somali journalists on media freedom and safety in Mogadishu

MOGADISHU, Somalia, 17 August, 2021 – Somali Journalists Syndicate (SJS) has on Monday concluded a three-day training which is part of a new series of trainings on media freedom and safety of journalists held in Mogadishu from 14th – 16th August.

Supported by the Canada Fund for Local Initiatives (CFLI), this training aims to improve the safety of professional local journalists and strengthen freedom of expression with reference to current trends in electoral processes in Somalia. Under this initiative, SJS intends to train around 80 journalists —half of them female — in four regions of the country.

Participants in this three-day training, many of them recently targeted by state security forces, were selected from various media stations in Mogadishu, Galgadud and Lower Shabelle.

During the three-day sessions, among the main topics discussed were the right to Freedom of Expression and the main local and international frameworks; safety and security advice for journalists; safety precaution for women reporters; dealing with potentially traumatic events; digital security as well as risk assessment for reporters before undertaking dangerous reporting assignments. Experts from Digital Shelter, a local organization that defends digital rights, and the Somali Explosives Management Authority provided important hands-on sessions and shared their experiences with participants.

Radio Barawe journalist Osman Aweys Bahar, who was among the participants, shared how the training has benefited him and explained how the skills he learned during the training sessions will strengthen his career when he return to his radio in Barawe.

“I am a journalist at Radio Barawe which is a community-owned radio station. I have been detained twice and my radio raided since April 2020. I am extremely excited to have been selected for this training,” said Mr. Bahar “I learned a lot of important safety and precaution tips. I did not know about risk assessment which is important for my job. But now I know it and I will use it for my work.”

CBA TV correspondent in Galmudug Maqsuud Abdullahi Mohamed, who is also SJS press freedom coordinator, noted that the training provided specific up-to-date information that is essential to her work and that of her colleagues.

“We are women journalists and we face various threats because of our work and our gender. Unfortunately, many of my fellow female reporters generally do not receive training. This training empowered us and made us fit for missions. I am excited about the high representation given to women colleagues. This was unprecedented,” adds Maqsuud “I want to urge female participants to use the content of the training and to support each other when you go back to your work stations.”

Radio Kulmiye journalist Fardowso Mohamud Sahal, who was assaulted and her phone confiscated by police during a public protest in Mogadishu in May, said the training provided her with a guidance on the protection of digital data as a journalist in the field.

“It was very significant and useful training for me. I congratulate SJS and the Canada Fund for Local Initiatives for their remarkable efforts in supporting Somali journalists. I am a reporter in the field. In May, the police attacked me and confiscated my phone. I didn’t know how to protect my data at the time,”adds Fardowso  “Thanks to the trainers, I have got new skills to protect my digital data.”

In his closing remarks on Monday, SJS Secretary General, Abdalle Ahmed Mumin said that while press freedom and space for independent media are threatened in Somalia, the training aims to equip participating journalists with relevant skills.

“This training is historic. First, it strengthens the safety capacity of our journalists and it comes at a time when many journalists are preparing to cover the electoral process in Somalia. Second, this training provides an opportunity for women journalists who are still under-represented in training, ”added Mr. Mumin “On behalf of the entire Somali journalist community, I appreciate the generous support of the Canadian government through the Canada Fund for local initiatives.”

“The training addressed both physical and online security concerns for journalists as well as the exercise of the right to freedom of expression. Today, these trained journalists are able to return back to their workplaces and operate safely in an extremely difficult environment.

As announced by SJS Secretary General, After the training, SJS will create a network of trained journalist alumni so that they can share their experiences with other journalists in other places in Somalia. SJS will also launch a survey to study lessons learned from the project so that it can be implemented in other regions of the country.

MOGADISHU, Somalia, July 28, 2021 – The Somali Journalists Syndicate (SJS) officially launched the first of a series of human rights trainings for Somali journalists in Mogadishu, on Wednesday, to build the capacity of journalists to cover human rights issues in Somalia.

The training project, which is supported by the National Endowment for Democracy, aims to equip local journalists with new skills and enable them to collaboratively monitor, investigate, document and report human rights violations in the country. The project intends to reach up-to 150 journalists across Somalia.

The trainings will serve as the foundation upon which SJS establishes and mentors a network of journalists covering human rights in six regions across Somalia.

Abdalle Ahmed Mumin, the Secretary General of Somali Journalists Syndicate appealed to journalists and editors of media houses to prioritize human rights coverage in their local and national coverage and to use the skills learned during the three-day training.

“Journalists can play a major role in protecting and promoting human rights. They can make people aware of their rights, expose violations, and help victims of human rights abuses to pursue their case till they achieve justice,” said Abdalle Ahmed Mumin, SJS Secretary General “Somali journalists continue to this struggle to report issues of public interest, but many lack the skills and tools to report professionally.”

“With the support of the National Endowment for Democracy (NED), we aim to build the capacity of journalists and editors on human rights principles. We hope to see a change in the media agenda and prioritize issues affecting human rights in the country,” Mr. Mumin adds “At the end of this training we’ll have an established network of human rights journalists. We’ll support them, provide them the mentorship and advice they need in order to increase their reporting capacity.”

At the opening ceremony on Wednesday, lawyers, media representatives and editors from the most recently targeted media stations were in attendance. About 25 reporters and editors from various media based in the capital, Mogadishu, will benefit from the first cycle of training followed by other trainings in other parts of the country.

Avv. Abdirahman Omar, a constitutional and human rights lawyer, said journalists and independent media who reported the truth were constantly exposed to intimidation and violence, making Somali journalists integral human rights defenders.

“Journalists are vulnerable human rights defenders. It’s taking place all over the world, but here in Somalia they have specific challenges. Therefore, training local journalists and equipping them is an important step in supporting them so that journalists can document and cover human rights issues in Somalia”, Avv. Omar said.

Amina Osman Hassan, a seasoned freelance female journalist pointed out the challenges faced by women reporters in Somalia as a lack of support, mentorship and well-tailored trainings for them.

“Trainings like this will give women journalists access to untold stories and enable then to report objectively and timely because they will get the skills and tools they need. I really thank SJS for bringing this human rights issue to the table,” she adds.

Hinda Dahir, an SJS gender rights defender, recounted how many local journalists have struggled to find training tailored to their specific needs, including those about research and documentation of human rights violations.

“Women in Somalia face all types of abuse, including rape and discrimination which remains underreported. Journalists participating in this particular training will learn how to report on all types of human rights, including violence against women,” she adds “It will help to speak for the victory of human rights. We hope to see an improvement in the human rights situation in the country while helping local reporters with reporting skills they needed much,” said Hinda Dahir.
